The Fire Zone Can Remove Capacity From Your Lot

This is unusual and most owners have never heard it. Bonus ADUs are not permitted in a Very High Fire Hazard Severity Zone where the lot fronts a cul-de-sac, or where the premises has only one point of ingress or egress.

Both conditions are common in hillside subdivisions built around loop roads and single-access streets. So a parcel that would otherwise carry additional units under the bonus programme may carry none, and the difference has nothing to do with the lot's size or the fire that just happened. Why Does Street Layout Affect What I Can Build?

Because it affects evacuation and emergency access. In a Very High Fire Hazard Severity Zone, a lot fronting a cul-de-sac or a premises with a single point of ingress or egress is excluded from bonus ADUs. It is a safety restriction rather than a zoning one, and it applies regardless of lot size.

And It Changes the Setbacks

The area developed principally from the 1970s onward. Under the 2025 ADU reforms, units in High and Very High Fire Hazard Severity Zones require a minimum 4 foot side and rear setback, and those amendments took effect 30 days after final passage outside the Coastal Zone. Standard ADUs are capped at 1,200 square feet. The Coastal Act took effect in 1977, and PRC Section 30610(g) limits a coastal replacement to 10 percent above the destroyed structure in floor area, height or bulk. The permitted unit count is set by lot area excluding environmentally sensitive lands.

Under the 2025 ADU reforms, accessory dwelling units in High and Very High Fire Hazard Severity Zones require a minimum four foot side and rear setback. On a constrained hillside parcel that can be the difference between a unit fitting and not fitting.

Taken together with the capacity restriction, the effect is that fire hazard designation in this part of the city reduces what a buyer can do rather than merely making it more expensive. A developer pricing the parcel on general San Diego ADU rules has overestimated.

Does the Fire Hazard Zone Raise My Rebuild Cost Too?

Yes, separately from the capacity question. Wildfire construction standards apply to a substantial rebuild on a mapped parcel, and hillside ground brings geotechnical and drainage work that level lots do not. The capacity restriction sits on top of those rather than instead of them.
